Terms & Conditions
1. Sponsor: The NAR Monroe 4/20 Cannabis Car Giveaway (the “Sweepstakes”) is sponsored by Hempnotize, LLC dba NAR Monroe, (the “Sponsor”) located at 14733 S Telegraph Rd, Monroe, MI 48161 (the “Business Premises”). No other company or entity is responsible for this Sweepstakes or the award of the Prize(s).
2. Disclaimer: The Sweepstakes is authorized pursuant to the promotional activity exception outlined in MCL 750.372(2). The Sweepstakes does not constitute a lottery or gift enterprise, as it is clearly occasional and ancillary to the Sponsor’s business, is expressly calculated to promote the Sponsor’s business enterprise and sale of its products, does not involve the payment of money solely for the chance or opportunity to win prizes, and entering does not entail purchasing products substantially more than their fair market value.
3. Who Can Enter: To enter the Sponsor’s Sweepstakes, individuals (“Eligible Entrants”) must be, at the time of entry, (i) a legal resident of the United States; (ii) twenty-one (21) years of age or older, and possesses unexpired State or Federal issued identification and (iii) must meet all other Sweepstakes entrance requirements as defined herein; Employees of the Sponsor or its respective parent companies and/or affiliates, their agents, and members of their immediate families and households are not eligible for the Sweepstakes. The Sweepstakes is void where prohibited or restricted by law or regulation.
4. Sweepstakes Period and Location: The Sweepstakes begins at 9:00 am Eastern Standard Time (“EST”) on March 20, 2024, and ends at the time of Winner Selection, 9:00pm EST on April 20, 2024, as outlined infra and is located at the Business Premises.
5. How to Enter: To enter the Sweepstakes, Eligible Entrants must make in-store purchases of products (as defined herein) on the Business Premises in exchange for tickets, which are then randomly drawn, during the Sweepstakes Period. The more spent by the Eligible Entrant (“Total Purchase Value”), the more tickets the Eligible Entrant receives for entry, and the greater the chances of winning prizes, as follows:
a. Ticket Allocation: One ticket equals one Sweepstakes entry. The more tickets submitted by the Eligible Entrant, the greater the chance of winning. Eligible Entrants may make multiple entries to the Sweepstakes subject to the rules and limitations provided herein.
b. Two Methods of Ticket Purchase: There are two methods Eligible Entrants may obtain tickets and enter for the chance of winning.
i. NAR 420 Care Package ($150.00; 5 Tickets): When an Eligible Entrant purchases the NAR 420 Care Package that is offered on the Business Premises during the Sweepstakes period, at the advertised price, they receive five (5) tickets
ii. In-Store Purchase of Eligible Products (1 Ticket per $100.00 spent by Eligible Entrants): An Eligible Entrant may also make in-store purchases of Eligible Products where they receive one ticket per $100 dollars spent, in increments of $100. 1. Eligible Products are defined as all products offered on the Sponsor’s Menu, including regular menu prices and any offered deals, at the Sponsor’s Business Premises during the Sweepstakes Period. Online/telephone purchases of Sponsor’s products are expressly excluded as a definition of Eligible Products. 2. Example: At least one ($100) hundred dollars spent by Eligible Entrant purchasing Eligible Products will result in the Eligible Entrant receiving one ticket for entry. Two ($200) hundred dollars spent will result in two tickets for entry, and so on. Note that combining this method of entry with the NAR 420 Care Package modifies total tickets received, see Section (iv) below.
1. Eligible Products are defined as all products offered on the Sponsor’s Menu, including regular menu prices and any offered deals, at the Sponsor’s Business Premises during the Sweepstakes Period. Online/telephone purchases of Sponsor’s products are expressly excluded as a definition of Eligible Products.
2. Example: At least one ($100) hundred dollars spent by Eligible Entrant purchasing Eligible Products will result in the Eligible Entrant receiving one ticket for entry. Two ($200) hundred dollars spent will result in two tickets for entry, and so on. Note that combining this method of entry with the NAR 420 Care Package modifies total tickets received, see Section (iv) below.
iii. No Ticket Limit: There is no limit as to how many tickets the Eligible Entrant may receive to enter the Sweepstakes Raffle.
iv. Combining Methods: Eligible Entrants may combine purchasing the NAR 420 Care Package and also In-Store Purchases of Eligible Products to receive more tickets for entry.
1. Purchasing the NAR 420 Care Package is an exclusive offer, of which Eligible Entrants will receive 5 tickets. It cannot be combined with the first $100 In-Store Purchase method to obtain additional tickets.
2. Combination Example 1: Eligible Entrant purchases the NAR 420 Care Package, and also makes additional In-Store Purchases of Eligible products, spending a total of $178.00. This Eligible Entrant is entitled to receive 5 tickets.
3. Combination Example 2: Eligible Entrant purchases the NAR 420 Care Package, and also makes additional In-Store Purchases of Eligible products, spending a total of $225.00. This Eligible Entrant is entitled to receive 6 tickets; 5 tickets from the NAR 420 Care Package, and 1 ticket for spending more than $200.00.
v. Total Purchase Value Includes Tax: The Total Purchase Value spent by Eligible Entrants includes applicable taxes. For example, if an Eligible Entrant spends $199.50 on In Store Purchases of Eligible Products, and tax brings the total to $211.44, the Eligible Entrant is entitled to receive 2 tickets for spending money over $200.
c. Eligible Entrants’ Contact Information: Upon receipt of tickets at time of purchase, Eligible Entrants will be able to write their full name, email OR Phone number on entry tickets. Those tickets will then be submitted back to the Sponsor and entered for a chance to win.
d. Limitation of Liability; Entrants’ Responsibilities: It is the express responsibility of Eligible Entrants to ensure they receive entry tickets at the time of purchase, to accurately and legibly record their contact information on each ticket, and to thereafter provide the ticket to the Sponsor in a timely manner. Eligible Entrants expressly agree and understand that it is these responsibilities are theirs solely. Eligible Entrants further acknowledge, and expressly release and hold harmless the Sponsor for providing entry tickets based on purchases made at the time of purchase, gathering tickets from entrants, and is absolved from responsibility where the ticket is in the sole discretion of the Sponsor determined to be illegibly written.
e. Entry of Tickets and Claiming Prize: Eligible Entrants obtain tickets at the time of purchase and provide them to the Sponsor to be eligible to win the Prizes. Prizes shall only be claimed within the Sweepstakes Period and as follows:
i. By the Prize winner holding the corresponding ticket matching the identifying ticket drawn.
ii. In person at the Sponsor Business Premises during the Sweepstakes Period.
iii. Following demonstration of Entrance Eligibility, including presentation of the Prize Winner’s government-issued identification.
iv. After confirming in writing via signature the Prize Winner’s agreement with these Official Rules.
v. The Prize Winner’s completion of any and all tax forms as required by the Sponsor in the Sponsor’s sole discretion.
6. Prizes: All prizes non-transferable and non-refundable, and no cash redemptions or substitutions are allowed except by Sponsor, who reserves the right to award a prize of equal or greater value, should a prize become unavailable for any reason. Any prize details and restrictions not specified will be determined by Sponsor in its sole discretion. Sponsor will not replace or repair any prize which, after winners accepts delivery, is lost, stolen, or damaged. Any difference between the approximate value and actual value of a prize (or any substitution prize) will not be awarded. Prizes consist only of items specifically listed as part of the prize. All costs and expenses not specified herein related to any prize or incurred by accepting the prize are the sole responsibility of the winners. Potential winners must complete and sign an affidavit of eligibility, a liability release, a publicity release, and complete all necessary tax documents as required by the Sponsor.
a. Grand Prize: 2024 Nissan Versa (VIN 3N1CN8DV1RL840584) (“Grand Prize”). The Grand Prize will have less than 50 miles on the odometer. Only one Grand Prize will be awarded. Except as stated above, the model, color, and options of the Grand Prize will be determined by Sponsor in its sole discretion. Winner is solely responsible for all federal, state, and local taxes, including incremental income taxes; license, title and registration fees; insurance; any optional or required safety equipment; and any other expenses related to acceptance and use of his/her prize. The Sponsor retains the right, in its sole discretion, to allocate any amount of ticket sales proceeds or any other amount (including zero dollars) towards any tax liabilities or any other costs allocated to the Grand Prize Winner as a result of winning the Grand Prize. The Sponsor makes no representations regarding the tax liability associated with any prize, and the Winner is advised to seek counsel regarding any tax liabilities associated with his/her prize. The Grand Prize will be awarded solely with any express written limited warranties set forth by the manufacturer in the applicable Owner’s Guide (if any), in which case any such warranties shall run for the term set forth in said Guide. Apart from any potentially applicable manufacturer warranties (if any), the Grand Prize will be awarded on an “AS-IS” basis without warranty, guaranty, or representation of any kind by the Sponsor, express or implied, in fact or in law, including without limitation any implied warranty of merchantability or fitness for a particular purpose, safety, legality for use in the winner’s jurisdiction of residence, durability, reliability, mechanical condition, and/or performance. The Grand Prize will be made available at a location and time within Michigan, as selected by Sponsor in its sole and absolute discretion.
The Grand Prize Winner (or Grand Prize Winner’s designated representative) may be required to present a valid vehicle driver’s license and evidence of insurance as a condition of acceptance of Grand Prize. The Grand Prize Winner (or Grand Prize Winner’s designated representative) must take delivery of his/her Grand Prize within 30 days of notice of winning (i.e., date on which Sponsor notifies Grand Prize Winner). If a Grand Prize Winner does not take delivery of the Grand Prize within a reasonable time (at the Sponsor’s sole discretion) or otherwise fails to satisfy the requirements set forth in these Official Rules, the Grand Prize will be forfeited and awarded to an alternate Grand Prize Winner selected at random from among the remaining applicable eligible entries. The vehicle manufacturer/registered trademark holder is in no way involved in the creation, execution, administration, or sponsorship of this Sweepstakes.
b. First Prize: 65-inch flat screen television. Winners are not entitled to a specific make/model of television. This prize will be awarded on an “AS-IS” basis without warranty, guaranty, or representation of any kind by the Sponsor, express or implied, in fact or in law, including without limitation any implied warranty of merchantability or fitness for a particular purpose, safety, legality for use in the winner’s jurisdiction of residence, durability, reliability, condition, and/or performance. Winners are responsible for any and all taxes and/or tax liabilities incurred as a result of winning.
c. Second Prize: Oculus Rift. Winners are not entitled to a specific make/model of Oculus Rift. This prize will be awarded on an “AS-IS” basis without warranty, guaranty, or representation of any kind by the Sponsor, express or implied, in fact or in law, including without limitation any implied warranty of merchantability or fitness for a particular purpose, safety, legality for use in the winner’s jurisdiction of residence, durability, reliability, condition, and/or performance. Winners are responsible for any and all taxes and/or tax liabilities incurred as a result of winning.
7. Winner Selection: At the conclusion of the Sweepstakes period, at approximately 9pm on April 20, 2024, (the exact specific time of which is subject solely and wholly to the discretion of the Sponsor) a random draw will be announced and conducted from all entries received. Odds of winning depend on the number of eligible entries received during the Sweepstakes Period and the number of Tickets submitted by Eligible Entrants. Three winning tickets will be drawn. The first drawn ticket will be the Second Prize. The next subsequent drawing will be the First Prize. The Final drawing will be the Grand Prize. If winners cannot claim their prizes after reasonable time and effort (as determined in Sponsor’s sole discretion), are found to be ineligible, or otherwise fails to comply with these Official Rules as solely determined by the Sponsor, that winner will be disqualified and subsequent Eligible Entrant(s) will be selected in the Winner’s place. If a winner returns or does not claim the Sweepstakes Prize, it will be forfeited, and no alternate or substitute prize will be awarded to the winner. The Sponsor will take all diligent measures to notify any and all winners within a reasonable time after determining the ticket winners. Eligible Entrants expressly acknowledge and agree that they are not entitled to any prizes, regardless of the possession of winning tickets. By participating in this Sweepstakes, Eligible Entrants release and hold harmless the Sponsor from any claims arising from the Sponsor’s sole discretion to determine that a winning Eligible Entrant is not entitled to receive a prize, for any reason.
8. Miscellaneous: Incomplete and ineligible entries are void. All federal, state, local, and provincial taxes, and all income and any other taxes, fees, and surcharges will be the sole responsibility of the Sweepstakes Prize winner. The Sponsor reserves the right in its sole discretion to suspend or terminate the Sweepstakes.
9. Conditions of Entry: By entering the Sweepstakes, each entrant agrees (i) to comply with these Official Rules, including all eligibility requirements; (ii) to be bound by the decisions of the Sponsor with respect to the Sweepstakes, which are final and binding in all respects; and (iii) that no claim relating to any allegation regarding the award, receipt, or use, of, any Sweepstakes prizes, and no claim for damages, losses, or injuries related to the same, shall be asserted against the Sponsor or its agents, affiliates, sale representatives, or advertising and promotion agencies. The Sweepstakes is subject to U.S. federal, state, and local laws and regulations. The Sponsor and its agents, affiliates, sales representatives, and advertising and promotion agencies make no warranty, guaranty, or representation of any kind concerning Sweepstakes prizes, and disclaim any implied warranty concerning Sweepstakes prizes, including, without limitation, the warranties of merchantability and fitness for a particular purpose. The Sponsor and its agents, affiliates, sales representatives, and advertising and promotion agencies are in no way responsible or liable for damage, loss, or injury resulting from (i) altered, late, lost, or incomplete entries; (ii) human, telephone, computer, online, or technical malfunctions or failures (including network unavailability and disconnections); or (iii) acceptance and use of Sweepstakes prizes or travel in connection with the Sweepstakes prizes. The Sponsor is not liable for a Sweepstakes prize that is misdelivered or nondeliverable because of incomplete or inaccurate address information, nor is it liable for any complication with a delivery service that renders the package containing Sweepstakes prizes nondeliverable. Sweepstakes prize winners assume liability for injuries caused or claimed to be caused by participation in the Sweepstakes or by the acceptance, possession, or use of the Sweepstakes prizes. The Sponsor will consider entries to have been submitted by the person whose name appears on the entry form. Winners will be required to execute an affidavit of eligibility, publicity release, and release of liability prior to receiving the Sweepstakes Prize.
10. Use Of Sweepstakes: Sponsor reserves the right to pass along the information submitted with an entry to a Sponsor representative.
11. Additional Terms: Any and all disputes relating to the Sweepstakes or Sweepstakes prizes shall be subject to the internal laws of the State of Michigan. ARBITRATION; WAIVER OF INJUNCTIVE RELIEF; BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES THAT ANY CONTROVERSY OR CLAIM ARISING OUT OF, OR RELATING TO THESE OFFICIAL RULES, THEIR ENFORCEMENT, ARBITRABILITY, OR INTERPRETATION SHALL BE SUBMITTED TO FINAL AND BINDING ARBITRATION, TO BE HELD IN OR NEAR TROY, MICHIGAN, AS DETERMINED BY SPONSOR, BEFORE A SINGLE ARBITRATOR UTILIZING THE RULES AND PROCESSES OF THE AMERICAN ARBITRATION ASSOCIATION. EACH PARTY SHALL BEAR HIS/HER OWN LEGAL EXPENSES IN SUCH ARBITRATION.
12. Publicity Release: Except where prohibited, acceptance of the prize constitutes winner’s consent that his or her name, likeness, voice and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.
13. Release of Liability: By entering, Eligible Entrants agrees to release and hold harmless Sponsor, its affiliates, sales representatives, agencies, wholesalers, distributors and promotional and other vendor agencies involved in the sweepstakes, their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations (“Releasees”) from any injury, loss or damage to person, including death, or property due in-whole or in-part, directly or indirectly, to the acceptance or use/misuse of the prize, participation in any sweepstakes-related activity, or participation in the Sweepstakes.
14. Limitation of Liability: Eligible Entrants release and hold harmless the Releasees from and against, any and all losses, damages, actions, demands, liabilities, or claims of whatever nature or kind arising out of, or in connection with a prize or any portion thereof or this Sweepstakes. Without limiting the generality of the foregoing, the Releasees will not be responsible for any typographical or other error in the printed or other related material related of this Sweepstakes, the administration of the Sweepstakes, the selection of entrants, in the announcement of the prize, including erroneous appearance of qualification for the prize, any entries or entrants disqualified for any of the reasons stated in these Official Rules, or any loss, damage or claims caused by, or in any way related to the prize or the Sweepstakes itself.
15. Changes to Sweepstakes and/or Official Rules: Under no circumstances will more than the stated number of prizes be awarded. The Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel, or suspend this Sweepstakes, or to amend the Official Rules at any time, without prior individual notice, should any factor interfere with the administration, security, or proper play of this Sweepstakes as contemplated by these Official Rules. If for any reason Sponsor is prevented from continuing with this Sweepstakes, or the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to fire, flood, pandemic, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial/territorial or local government law, order or regulation, order of any court or jurisdiction, Sponsor shall have the right, but not the obligation, in its sole and absolute discretion, to award the prize from among all entries received to date.
16. Sweepstakes Governing Rules: The Sweepstakes will be run in accordance with these Official Rules, which shall prevail, govern and control in the event of any inconsistency with any Sweepstakes-related materials.
